Woman Jailed For ‘Duping Friend Into Lesbian Relationship’ By Using A Male Persona, Has Conviction Quashed

An appeals court has turned over the conviction against Gayle Newland over allegations that the judge presiding over the case was not ‘properly fair and balanced’.

The defendant was originally found guilty of three counts of sexual assault over the 2013 incidents, while both her and the alleged victim were studying at the University of Chester.

Newland was accused of impersonating a man to have sex with her female friend, a feat she pulled off multiple times using a variety of disguises including a fake identity, a prosthetic penis, and a curve suppressing bathing suit.

Her alleged victim – a woman who cannot be named for legal reasons – had told Chester Crown Court that she had embarked on a relationship with a man that she met on Facebook, who used the name Kye Fortune.

The woman told the court that when meeting up with Fortune in real life to have consensual sex, she was convinced to wear a blindfold at all times during sex sessions, because Fortune claimed to have insecurities about his appearance.

However, after meeting up on a number of occasions, the woman tore off the blindfold during a sexual encounter – and was shocked find not her supposed boyfriend, but Newland allegedly penetrating her with a prosthetic penis.

The woman claims that Newland had manufactured the fake identity, and disguised her appearance by binding her breasts and wearing a hat, in order to pass as the fictional man and trick her into sex.

A petition to release Newland corroborated her side of the story, arguing:

The truth is Gayle was nothing but loyal, caring and passionate towards her lover, who knew who she truly was. Gayle is a beautiful girl, she didn’t have any reason to hide behind a false identity in order to pursue the affectionate relationship she had with the claimant. Gayle is now open about her sexuality and has been for some time. However, this was not the case during the time she and her partner were together.

Both agreed to keep their sexuality and relationship secret in order to process the situation as well as their feelings towards one another, without outside judgement. Towards the end of their relationship Gayle eventually admitted to her partner that she wished to open up about herself to her parents.

This sparked an argument between Gayle and the claimant and a couple days later the police had gotten involved, hence the beginning of the case. It is obvious that the claimant was terrified that the truth about her sexuality would come out and, likely out of desperation, would go to extreme lengths to deny being sexually involved with a female.”

Newland was initially jailed for eight years, but challenged the conviction in an appeal.

Now, Lady Justice Hallett, Mr Justice King and Mr Justice Dove, have quashed her conviction and agreed to release her on bail.

Newland’s lawyer had argued the previous conviction was “unsafe” as the trial judge had neglected to be ‘properly fair and balanced’ while summing up the case for the jury.

A retrial has been ordered, though no date has been set.

Woman Jailed For 8 Years For Posing As Man To Have Sex With Another Women

A woman has been sentenced to eight years in jail for posing to be a man in order to have a sexual relationship with another woman that she met online.

In 2011, Gayle Newland, of Cheshire, England, created a Facebook profile under the name Kye Fortune, and began an online relationship with the complainant, who cannot be named for legal reasons.

When the two finally arranged to meet in 2013, Newland asked the other woman to wear a blindfold. She continued to ask her to wear a blindfold for subsequent meetings, telling her that ‘Kye’ was self-conscious of his appearance because of a disfiguring injury.

The two women had sex around ten times, until the complainant tore off her mask and saw Newland wearing a prosthetic penis.

Newland was found guilty after trial in September, and today she was sentenced at a hearing at Chester Crown Court.

In ruling, Judge Roger Dutton labelled Newland,

… an intelligent, obsessional, highly manipulative, deceitful, scheming and thoroughly determined young woman,”

Adding;

To successfully pass off a deception of this complexity was a major undertaking involving dedicated mobile phone lines as well as regular texts from you purporting to be Kye’s relatives. You pursued this course of conduct over a lengthy period during which you played with her affections, acting entirely for your own sexual satisfaction and choosing to ignore the devastating impact that the eventual discovery of the truth would have on her.”

Newland had claimed in her defense that no blindfold had ever been used and that the defendant had always known that she was a woman, but that they had engaged in role-play while exploring their sexuality.

The complainant has said that she is not gay.

Newland’s defence team said it was it was ‘impossible to believe’ the complainant’s statement that she had believed Newland to be a man.

However, evidence introduced to the court included emails that Newland had sent to the complainant after her mask had been removed apologizing for her actions.

The jury found her guilty of three counts of sexual assault. She was cleared of two further counts of sexual assault that were alleged to have taken place at hotels in Hoole and Chester, reports the Chester Chronicle.

Newland’s legal team asked the judge to show mercy in her sentencing, pointing to psychiatric reports that Newland suffered from a range of disorders, and that she had struggled to come to terms with her sexuality.

However,  judge as rejected this saying

These offences are so serious that only an immediate sentence of custody will reflect the seriousness of conduct.”

Newland was visibly distressed throughout the sentencing hearing, shouting ‘I’m scared’ to the court.

On being told the actual sentence, she had to be held up and forcibly removed from the dock by two officers and could be heard to cry and scream as she was led away from the courtroom.

Throughout the trial she has enjoyed support from friends and family, many of whom sobbed in the public gallery on hearing the judge’s sentence.

Detective Inspector Clare Coleman, head of Cheshire Constabulary’s Dedicated Rape Unit, said:

The sentence handed down today reflects the seriousness of this crime. This has been a highly unusual and complex investigation. There has been a lot of interest in this case due to the extraordinary circumstances, but it is important to remember that there is a victim at the heart of all of this.’

I just pulled it off. Gayle was just standing there… I just couldn’t believe it, I couldn’t believe it. Straight away she held her hand down over her face and said ‘it’s not what you think’.”

She added:

I know it sounds pathetic, but I was just so happy at the time because I was in love with this person and we’d built this beautiful relationship. It was just based on, you know, our minds and all the other things that we had in common so I just felt grateful that I’d finally got a proper relationship.”

Prosecutor Matthew Corbett-Jones says that that though the woman had consented to sex, the defendant “sexually assaulted” her as “at no time” did she consent with Newland, using a prosthetic penis.

Judge Roger Dutton said that Newland had “serious issues surrounding her personality”.

The judge told her:

You have been convicted of serious charges. You must understand the consequences may be serious. Sentencing guidelines are quite clear that imprisonment is inevitable, but I need a good deal of further examination before I take that further step.”

However, Newland protested her innocence, shouting:

How can you send me down for something I have not done? I don’t understand, I don’t understand.”

She was bailed until sentencing in November.
